This “Privacy Notice” describes the privacy practices of PerfectVision Manufacturing, Inc. and our subsidiaries and affiliates (collectively “PerfectVision,” “we,” “us,” or “our’) with respect to the information we collect on www.perfect-vision.com (the “Website”), Chuzo websites www.chuzo.com and shoplink.chuzo.com and application (the “Chuzo Products”), and offline interactions you have with us (collectively our “Services”). This Privacy Notice also explains the rights and choices available to individuals with respect to their information. By using our Services you acknowledge the data handling policies outlined in this Privacy Notice. If you do not agree with our policies, please do not use our Services.

Updates to this Notice
We may update this Privacy Notice based upon evolving laws, regulations and industry standards, or as we may make changes to our Services. We will post changes to our Privacy Notice on this page and Chuzo Products, and encourage you to review our Privacy Notice when you use our Services to stay informed. If we make changes that materially alter your privacy rights, we will take commercially reasonable measures to inform you, consistent with the significance of the changes we make.  If you disagree with the changes to this Privacy Notice, you should discontinue your use of our Services.

Personal Information We Collect

Information You Provide Us
We collect certain information from you by which you may be personally identified, such as your name, last name, email address, level of completed education, credit card number and phone number (collectively “Personal Information”). You may provide us with this information on our Website when you register for an account, submit a work application, or sign up for our newsletter.

Information You Provide Service Providers
We receive your Personal Information from other sources such as service providers who you share your Personal Information with and who may help you input your Personal Information into Chuzo Products. You may provide us with your name, last name, email address, credit card number, phone number and social security number in Chuzo Products in order to receive more information about our services. Your social security number is used solely to verify your identity and provide you with a list of available services, we do not store your social security number in any capacity. We may also receive your Personal Information from publicly available databases.

Information We Automatically Collect
When you visit the Website, we may automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the trackers that are installed on your device using cookies and similar technologies. Additionally, as you browse the Website, we may collect information about the individual web pages and services that you view, what websites or search terms referred you to the Website, and information about how you interact with the Website. We may automatically collect this information using the following technologies:

Children
Our Services are not directed to, and we do not knowingly collect Personal Information from, anyone under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information, they should contact us. We will delete such information from our files as soon as reasonably practicable.

How We Use Your Personal Information
We use the Personal Information we collect from you in the following ways:

  • For the performance of a contract and the development, compliance and undertaking of any contract you may have with us;

We disclose your Personal Information:

  • To our third-party service providers, to facilitate services they provide to us. These can include providers of services such as data analysis, payment processing, order fulfillment, information technology and related infrastructure provision, user support service, email delivery, auditing, and other services;
  • To companies we work with in order to provide you with any Services you have requested from us; and
  • To comply with applicable laws, regulations, respond to subpoenas, search warrants or other lawful request for information we receive, or to otherwise protect our rights.

We do not sell your Personal Information to third parties and will not do so unless we provide you with advance notice. We may share Personal Information with our service providers and partner companies who use your Personal Information to provide you with Services you request. Information you provide in Chuzo Products is not sold for any purpose.
We may disclose your Personal Information as part of a corporate business transaction such as a merger or acquisition, divestiture, sale of company assets, or in the event of insolvency, bankruptcy, or receivership. In these cases, Personal Information could be transferred to third parties as a business asset. We may also share information with banks and similar entities for purposes of transferring loans in connection with your device financing.
You may apply to job positions using our ADP portal. Your use of our application portal is governed by ADP’s privacy policy, which you can access here.

Privacy Technology Practices

Do Not Track Signals
Some browsers have incorporated “do not track” features to enable users to make privacy and security choices. By using these settings, your browser may send a signal to our Website not to collect tracking information. Please note that we do not alter our Website’s data collection and use practices when we see a “do not track” signal from your browser.

Data Security
We are committed to protecting the security of your Personal Information. Depending on the circumstances, we may hold your information in hard copy and/or electronic form. For each medium, we use technologies and procedures to protect Personal Information. We review our strategies and update as necessary to meet our business needs, changes in technology, and regulatory requirements. These measures include, but are not limited to, technical and organizational security policies and procedures, security controls, and employee training.

You are responsible for maintaining the security of any account credentials that may be issued to you as you use the Website. We will treat access to the Website through your account credentials as authorized by you. Unauthorized access to password-protected or secure areas is prohibited and may lead to criminal prosecution. We may suspend your use of all or part of the Website without notice if we suspect or detect any breach of security. If you believe that information you provided to us is no longer secure, please notify us immediately using the contact information provided below.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Website. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

Data Retention
We retain your Personal Information for as long as we have a business relationship with you. The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide our Services to you (for example, for as long as you have an account with us or keep using our Services);
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or
  • Whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

Your Personal Information will be deleted or anonymized three (3) years after your last activity with our business. We may retain your account information and order information for our records for up to seven (7) years after your last transaction. We reserve the right to retain anonymized and aggregate information indefinitely.

California Consumer Privacy Rights
This section outlines data privacy rights afforded to California residents and certain disclosures that are required by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA).
Categories of Personal Information Disclosed
We have disclosed the following categories of Personal Information as listed in the CCPA to third parties for our operational business purposes within the preceding twelve (12) months:

  • Category A: Identifiers, such as name, contact information, IP address and other online identifiers;
  • Category B: Personal Information, as defined in the California customer records law, such as name, contact information, payment card number, financial information, employment information, insurance information, and government-issued ID numbers;
  • Category C: Characteristics of protected classifications under California or federal law, such as marital status;
  • Category D: Commercial information, such as transaction information and purchase history;
  • Category F: Internet or other network activity such as information about how you interact with our Website;
  • Category H: Geolocation data, such as device location;
  • Category G: Professional or employment-related information;
  • Category J: Education information that is not publicly available; and
  • Category K: Inferences drawn from any of the Personal Information listed above to create a profile about, for example, an individual’s preferences and characteristics.

Right to Know
You may request information about how we have collected, used and shared your Personal Information during the past twelve (12) months.
Right to Access
You may request a copy of the Personal Information that we maintain about you.
Right to Delete
You may request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions.
Right to Correct
You may request that we correct any of your Personal Information that has become outdated or needs correction for any reason.
Exercising Your Rights
To access or delete specific pieces of Personal Information we will need to verify your identity to the degree of certainty required by law. As permitted by applicable law, any request you submit to us is subject to an identification and residency verification process (a “Verifiable Consumer Request”). We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the consumer about whom we collected Personal Information. California residents may exercise their rights described above by emailing us at privacy@perfect-vision.com with subject line “Verifiable Consumer Request.”
Only you, or someone legally authorized to act on your behalf (an “Authorized Agent”), may make a request to know or delete related to your personal data. We require Authorized Agents to provide written authorization confirming they may submit a request on your behalf. You may only submit a request to know twice within a twelve (12)-month period. We endeavor to substantively respond to a Verifiable Consumer Request within forty-five (45) days of its receipt, unless we require an extension. If we reasonably require an extension, we will inform you of the reason and extension period.
Once we receive your request and confirm your identity, we will review your request. We may deny your request if retaining the information is proper and necessary or if an exception allowing us to retain the information applies.
Non-Discrimination
We will not discriminate against you for exercising any of your data subject rights. We do not charge a fee to process or respond to your Verifiable Consumer Request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Shine The Light Law
